COWETA COUNTY, GEORGIA THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Calvin D. Richards and Lavonia B. Richards to Mortgage Electronic Registration Systems Inc., as nominee for Branch Banking and Trust Company, dated March 20, 2006, and recorded in Deed Book 2930, Page 750, Coweta County, Georgia Records, as last transferred to Branch Banking and Trust Company by assignment recorded on August 15, 2013 in Book 3997 Page 208 in the Office of the Clerk of Superior Court of Coweta County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Four Thousand Eight Hundred and 0/100 dollars ($104,800.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Coweta County, Georgia, within the legal hours of sale on June 6, 2017, the following described property: All that tract or parcel of land situate, lying and being in the City of Newnan, Coweta County, Georgia, and being Lot 9, Block B, Glenwood Heights Subdivision Section 1, as shown by plat of survey of property of H. W. Richards, Glenwood Heights, Section 1, Subdivision, made by T. Y. Mattox, Surveyor, on September 28, 1954, and recorded in Plat Book 1, Page 113, in the Office of the Clerk of the Superior Court of Coweta county, Georgia, and being more particularly described as follows: BEGINNING at a point on the southeasterly side of Connor Drive in said City, which said point is 124.8 feet southwest of the intersection made by the southeasterly side of Connor Drive with the southwesterly side of Waverly Circle, as measured along the southeasterly side of Connor Drive, if said street lines were extended to form an angle instead of a curve, and which said point marks the northernmost corner of Lot 10, Block B of said Subdivision, and running thence South 40 degrees 45 minutes east along the northeast line of Lot 10, Block B of said Subdivision 168 feet to an iron pin on the northwest line of Lot 8, Block B of said Subdivision, thence North 42 degrees 47 minutes East along the northwest line of Lot 8, Block B, of said subdivision 125 feet to the southwest side of Waverly Circle, thence North 40 degrees 38 minutes West along the southwest side of Waverly Circle 120 feet to the point of curve, thence along the curve of Waverly Circle 55 feet to the point of curve on the southeast side of Connor Drive thence South 44 degrees 56 minutes west along the Southeast side of Connor Drive 81.5 feet to the beginning point, according to a plat of property made by T. Y. Mattox, dated November 9, 1971 recorded in Plat Book 15, Page 281 in the Office of the Clerk of the Superior Court of Coweta County, to which plat reference is hereby made for a more accurate description of the property herein conveyed. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Richards or tenant(s); and said property is more commonly known as 20 Waverly Circle, Newnan, GA 30263. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
