STATE OF GEORGIA COUNTY OF COWETA Because of a default under the terms of the Security Deed executed by Gregory L. Pierce and Amy N. Pierce to First Mortgage Company dated July 28, 2005, and recorded in Deed Book 2786, Page 690, Coweta County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. securing a Note in the original principal amount of $289,600.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, June 6, 2017, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that tract or parcel of land situate, lying and being in Land Lot 170 of the Eighth Land District Coweta County, Georgia, containing 5.685 acres and being more particularly described on plat of property dated 12/3/96 prepared for Gregory L. Pierce and Amy N. Pierce by John R. Christopher, Georgia Registered Land Surveyor, said plat of record in Plat Book 64, Page 54, Office of the Clerk, Coweta County Superior Court, reference to which plat is hereby made for a more particular description of the tract herein conveyed. Said tract is described according to said plat as follows: Begin at a point located on the Northeasterly right of way of Adcock Road, said point being 2,852.07 feet Southeast of the point of intersection of the Northeast right of way of Adcock Road with West land lot line of Land Lot 169 of the Eighth Land District, Coweta County, Georgia, all as measured along the Northeasterly right of way of Adcock Road and from said beginning point run thence North 21 degrees 10' 57" East 348.73 feet to a point; thence run South 70 degrees 49' 03" East 396.01 feet to a point located on the East land lot line of Land Lot 170 of the Eighth Land District, Coweta County, Georgia; thence run along said land lot line South 00 degrees 17' 24" East 631.95 feet to a point located on said land lot line; thence run South 88 degrees 58' 03" West 85.18 feet to a point located on the Northeasterly right of way of Adcock Road; thence run along said right of way North 43 degrees 12' 09" West 102.23 feet to a point located on said right of way; thence continue along said right of way North 44 degrees 50' 37" West 281.83 feet to a point located on said right of way; thence continue along said right of way North 42 degrees 47' 30" West 181.76 feet to a point located on said right of way; thence continue along said right of way North 40 degrees 06' 47" West 40.15 feet to a point located on said right of way and the point of beginning. Said property is known as 1420 Adcock Road, Newnan, GA 30263, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
