Because of a default under the terms of the Security Deed executed by Richard D. Stephens, Sr. and Linda B. Stephens to Mortgage Electronic Registration Systems, Inc. as nominee for Market Street Mortgage Corporation dated January 31, 2007, and recorded in Deed Book 3134, Page 611, Coweta County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. securing a Note in the original principal amount of $84,848.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, March 7, 2017, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that tract or parcel of land lying and being in Land Lot 53 of the Second Land District of Coweta County, Georgia, and being more particularly described as follows: BEGINNING at a point on the Southeast right-of-way line of the dirt road to Moody's farm (said road having a 50-foot right-of-way), said point lying 1,561.71 feet northeast of the intersection of the southeast right-of-way line of the dirt road to Moody's farm with the South line of Land Lot 53; running thence northeast along the southeast right of way line of the dirt road to Moody's farm 304.46 feet to an iron pin on the southeast right of way line of said road; running thence North 89 degrees 57 minutes 00 seconds East 1,236.57 feet to an iron pin; running thence South 00 degrees 10 minutes 55 seconds East 300 feet to an iron pin; running thence South 89 degrees 57 minutes 00 seconds West 1,275.20 feet to an iron pin on the Southeast right of way line of the dirt road to Moody's farm and the point of beginning; containing 8.601 acres, more or less, and known as Tract 21B; being the same property described and conveyed in Warranty Deed from J.C. Hudgens and Ernest B. Lynn to Homer L. Miller, dated February 1, 1996, recorded in Deed Book 996, Page 35, in the Deed Records of Coweta County. Georgia. LESS AND EXCEPT: All that tract or parcel of land containing 1.29 acres, more or less, situate lying and being in Land Lot 53 of the 2nd Land District of Coweta County, Georgia and being a portion of Lot 21-B, Millard Farmer Estates,. and being identified as Tract C as shown on plat of survey for Billy Cranford, prepared by Randy McClain, R.L.S., dated November 29, 2001, as recorded in Plat Book 75, Page 69, in the Clerk's Office of the Superior Court of Coweta County, Georgia, said recorded plat being incorporated herein by reference and made a part of this description; said 1.29 acres having been conveyed to Cranford Homes, Inc., on December 14, 2000, by Warranty Deed recorded December 14, 2001, in Deed Book 1801, Page 73, aforesaid records. ALSO LESS AND EXCEPT: All that tract or parcel of land lying and being in Land Lot 53 of the 2nd District of Coweta County, Georgia consisting of 2.51 acres, shown as "Part of Tract 21B" on property survey for Homer L. Miller dated July 29, 1996, last revised 10/30/1996, and recorded in Plat Book 65, Page 141 in the Clerk's Office of the Superior Court of Coweta County, Georgia, and being more particularly described as follows: BEG1NNING at the intersection of the south line of Land Lot 53 and the east line of Moody Farm Road; thence northerly along the east right of way of Moody Farm Road for a distance of 1834.10 feet (incorrectly shown as 1934.10 feet on recorded plat and in prior deeds) to an iron pin at the TRUE POINT OF BEGINNING; thence north 89 degrees 57 minutes east for a distance of 815.40 feet to an iron pin; thence south 0 degrees 11 minutes east for a distance of 170.24 feet to an iron pin; thence north 89 degrees 57 minutes east for a distance of 425.00 feet to an iron pin; thence north 0 degrees 11 minutes west for a distance of 200.00 feet to an iron pin; thence south 89 degrees 57 minutes west for a distance of 1,236.57 feet to an iron pin; thence south 07 degrees 09 minutes west for a distance of 30.00 feet to an iron pin at the true point of beginning; said 2.51 acres having been conveyed in Foreclosure Deed Under Power of Sale, dated March 6, 2001, to William J. Wade, Trustee, of Mid-State Trust VI, recorded in Deed Book 1634, page 375, aforesaid records. Together with that 2001 Jaguar Mobile Home under VIN ID #GMHGA40101278223AB. Said property is known as 144 Moody Farm Road, Newnan, GA 30263, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
