STATE OF GEORGIA COUNTY OF COWETA Under and by virtue of the power of sale contained with that certain Security Deed dated June 21, 2005, from ERIC L. OXENDINE to Mortgage Electronic Registration Systems, Inc. as Nominee for Market Street Mortgage Corporation, recorded on July 19, 2005 in Deed Book 2779 at Page 302, Coweta County, Georgia Records, having been last sold, assigned, transferred and conveyed to BANK OF AMERICA, N.A. by Assignment and said Security Deed having been given to secure a note dated June 21, 2005, in the amount of $50,039.00, said note being modified by Loan Modification Agreement in the amount of $51,209.88 and recorded on February 18, 2013 at Book 3910, Page 69 Coweta County, Georgia Records and said Note and Loan Modification being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Coweta County, Georgia, on July 5, 2017, the following described real property (hereinafter referred to as the "Property"): ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 9 OF THE 5TH LAND DISTRICT OF COWETA COUNTY, GEORGIA AND BEING IDENTIFIED AS LOT 269 OF SECTION 2 OF ARNALL and ARNCO VILLAGE SUBDIVISION, AS SHOWN OF PLAT OF SURVEY ENTITLED "ARNALL andARNCO SUBDIVISON, BIBB MANUFACTURING COMPANY, COWETA COUNTY, GEORGIA." PREPARED BY PIEDMONT ENGINEERS and ARCHITECTS, DATED OCTOBER 1970, AS RECORDED IN PLAT BOOK 14, PAGES 229 AND 231, COWETA COUNTY RECORDS AND BEING MORE PARTICULARLY IDENTIFIED AND DESCRIBED ACCORDING TO PLAT OF SURVEY FOR JOHN R. HIESTAND, DATED JUNE 8, 1989, MADE BY JOHN R. CHRISTOPHER, REGISTERED LAND SURVEYOR, AS RECORDED IN PLAT BOOK 47, PAGE 5, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF COWETA COUNTY, GEORGIA, REFERENCE TO BOTH PLATS IS HEREBY MADE FOR A MORE PARTICULAR AND ACCURATE DESCRIPTION OF THE PROPERTY DESCRIBED HEREIN. The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are ERIC L. OXENDINE and Roberta L. Oxendine The property, being commonly known as 19 Arnco Fifth Street, Newnan, GA, 30263 in Coweta County, will be sold as the property of ERIC L. OXENDINE and Roberta L. Oxendine, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
